Consumer rights in Jersey

On this page, we outline the consumer rights that are applicable in Jersey.
As a Crown Dependency, independent from the United Kingdom, Jersey has its own legislation to protect Islanders from unfair business practices: the Consumer Protection (Unfair Practices) (Jersey) Law 2018.
While it covers a lot of the same areas as the UK law, it's important to know where the situation in Jersey may differ to the rest of the British Isles.
🛡️ Your rights as a consumer

Honesty: Businesses must not lie or give misleading information about a product (price, quality, safety, origin, etc.).

No Hidden Info: Important facts must be shared clearly (for example, the full price, extra fees, and return rights).

No Pressure: Businesses can't bully, harass, or scare you into buying.

Fair Treatment: Businesses must act honestly and with reasonable skill and care.

Full Protection: Your rights apply before, during, and after the sale.
🚨 Some practices are always illegal

Pretending something is "free" when you have to pay hidden costs.

Falsely claiming that a product can cure illnesses or medical conditions.

Running fake prize competitions where you have to pay to claim.

Pretending to be officially approved or endorsed when they aren't.

Using fake trust badges or quality marks.
🛒 What about returning items after buying them?
Returns are covered under separate legislation – the Supply of Goods and Services (Jersey) Regulations 2010. It says that consumers can return goods to shops in some cases:

If the product is faulty (for example, it doesn’t work, it’s damaged, or it’s not as described) — you have the right to a repair, replacement, or refund.

You must act reasonably quickly — don’t wait months to complain once you notice a problem.

No automatic right to return if you change your mind — unless the shop has its own returns policy offering this (many shops do offer goodwill returns, but they don't legally have to).
💻 There are special rules for online or phone sale
Sellers must clearly inform you:

Who they're selling on behalf of.
-
The total price (including all fees and charges).

That you have the right to cancel or return the product.
The Distance Selling (Jersey) Law 2007 covers returning goods and services bought online or by phone. It states:

You usually get a seven-day cooling-off period, during which you can cancel the order for any reason, even if you just change your mind.

The seven days start from the day after you receive the goods.
There are some exceptions. You might not be able to cancel certain things, like:

Perishable goods (like food or flowers)

Personalised or custom-made items

Sealed products (like DVDs or software) once you open them
If you cancel in time:

You must return the item.
-
The seller must refund you (including the basic delivery cost).

You may have to pay to send it back unless they offer free returns.
🚨 If things go wrong

Businesses that break these rules can be fined.

Authorities can investigate, seize goods, and take court action.

You have strong rights — don't be afraid to use them!

Keep any receipts, emails, or adverts — they are your evidence.
If you're unsure or feel pressured into buying something, walk away and report it.
